Jacob Henning's Will

The State of Ohio, Darke County, ss:

Be it Remembered that on the seventeenth day of September in the year of our Lord one thousand eight hundred and fifty eight, a writing was produced before the Probate court of said county purporting to be the last will and testament of Jacob Henning Sen. late of said county deceased, and John Armstrong and Samuel Bechtolt the subscribing witnesses to said will appeared in open court and on oath testified to the due exectuion and attestation of said will and their testimony reduced(?) to writing and by them respectively subscribed is annexed to and filed with said will -- and it appearing to the court that said will was duly executed and attested, and at the time of the execution thereof, said Testator was of full age, of sound mind and memory and not under any restraint. It is therefore ordered by the court that said will be, and the same is hereby admitted to probate, and that the said will together with the testimony of the subscribing witnesses be recorded - and the same are in the words and figures following, ____(?):

"In the name of the Benevolent Father of all - I Jacob Henning Sr. of Darke County Ohio, do make and publish this my last will and testament.

Item First. I give and devise to my Beloved wife in lieu of her dower the farm on which we now reside, situated in Darke County Ohio, and being the South part of Section thirty six, in Township twelve, Range one East, containing about sixty two acres during her natural life, and all the chattle property, notes and credits - after my just debts are paid or so much therof as she may think necessary for and during her natural life, if any of my money, credits and chattle property should be left after my debts are paid and my widow takes what she thinks she may need, to be equally divided amongst my children living and to the children of those deceased, one child's share and at any and all times that there may be money more than my widow may want, to be divided to my children as above.

Item Second. It is my will that after my said wife's decease, the real estate and chattle property be sold and the proceeds thereof be equally divided between my children as above stated.

Item Third. I do hereby nominate and appoint Absalom Shade Executor of this my last will and testament. I do hereby revoke all former wills by me made. In testimony whereof I have hereunto set my hand and seal, the 15th day of March 1856.

The State of Ohio, Darke county,ss:

In Probate court, September 17th A.D. 1858, Personally came into open court John Armstrong and Samuel Bechtolt subscribing witnesses to the last will and testament of Jacob Henning late of said county deceased: who being duly sworn depose and say that they were present at the execution of the will - that they saw the Testator sign and heard him acknowledge the same as his last will and testament, and that at the time of executing the same, said Testator was of full age, of sound mind & memory, and not under any apparant restraints to their knowledge and belief.

I hereby certify that the above and foregoing is a full, true, and correct copy of the last will and testament of Jacob Henning Sr. deceased, together with the probate and proceedings had thereon .... full and entire as the same appears on record and on file in the Probate court of Darke county, Ohio.

Witness my signature & official seal this 12th day of April 1865.
