In the Name -- of the Benevolent father of All I James Miller of Darke County and State of Ohio Do Make and Publish this my last Will and Testament I Give and Bequeath Devise to my Beloved Wife in lieu of Her Dower the farm on which we now reside situated in York Township Darke Co Ohio Containing Eighty acres of land more or less During Her natural life and all the stock Household goods furniture provision and other goods and chattels which may belong to me at the time of my Decease During Her natuarl life as aforesaid She selling so much Thereof as will be sufficient to pay my past Debts at the death of my said Wife the Real Estate and person [sic.] property I give and devise to my legal Heirs and their Heirs and assignes [sic.] forever and I do Hereby appoint my Beloved wife guardian of my Daughter Nancy Miller until the said Nancy Miller shalt shall [sic.] arrive at the age of Eighteen years or Enter marryes [sic.] and I Do Hereby appoint my Beloved wife my Executrix of this my last will and testament and I Desire that no appraisement and no sale of my personal property be made and that the Court of probate direct the omision [sic.] of the same in p---eance of the statute and I Do Hereby Revoke all all [sic.] former Wills I in testimony hereof I Have Hereunto set my hand and seal this the fifteenth Day of October AD 1867

State of Ohio, Darke County IN PROBATE COURT, January 4 A.D. 1868. Personally came into open Court, David Oliver S W Miller and Henry Boomershine subscribing witnesses to the last Will and Testament of James T. Miller late of said County, deceased, who duly sworn, depose and say that they were present at the execution of the WILL--that they saw the Testator sign, and heard him acknowledge the same his last Will and Testament, and that at the time of executing the same, said Testator was of full age, of sound mind and memory, and not under any apparent restraint, to their knowledge and belief.
