Joseph Brandon vs. Walter Brandon, etal. - May 7, 1839 - On August 30, 1837, Joseph Brandon filed a petition in chancery in which he represents that Richard Brandon late of said county on or about the 20th. day of October A.D. 1835 died intestate seized free and simple of the East half of the South West Quarter, section 18, Township 10, Range 4 east in darke County, Ohio, containing 81 acres.

That said Richard Brandon left no widow entitled to dower in said premises, that said Richard Brandon left heirs at law being his children and next of kin to said estate, as follows, towit: Walter Brandon, Jonathon Brandon, John Brandon, David Brandon, Richard Brandon, Joesph Brandon, Vincent G. Brandon and Mary Brandon.

Your petitioner further states that Walter Brandon the first son of Richard Brandon deceased, intermarried and on or about __________ (left blank) died leaving said widow and children his heirs at law; Sarah intermarried with Peter Homan of Preble Co., Ohio; James Brandon of Darke Co.; Walter Brandon who has died leaving Sarah, his widow and five children, Julian Brandon age 12 years, Lavina Brandon aged 11 years, Hurran Brandon aged 10 years, Squire M. Brandon aged 8 years, Margaret Brandon aged 6 years, all living in Darke Co. Ohio; Squire M. Brandon who lives in Cass Co. Indiana; Mariah Brandon who intermarried with Alexander B. Brandon living in Darke Co. Ohio; Levi Brandon who lives in Darke Co. Ohio; and Harriet Brandon aged about 17 years living in Darke Co. Ohio.

That Jonathan Brandon, second son of said Richard Brandon died about ____________ (left blank) leaving Mary Brandon his widow, whose place of residence is not known and five children as follows: Lewis Brandon, residence unknown; Matilda Brandon intermarried to Jacoriah Simmons living in Indiana; Richard G. Brandon living in Preble Co. Ohio; Nancy Jane Brandon intermarried with Thomas M. Brown living in Preble Co. Ohio; and Zelpha who intermarried with John Sawyer, who has since deceased leaving children unknown to petitioner.

That John Brandon, third son of Richard Brandon, deceased, is now living in Darke Co. Ohio.

That David Brandon, fourth son of Richard Brandon, deceased is now living in Darke Co. Ohio.

That Richard Brandon Junior, fifth son of Richard Brandon, deceased, died leaving Anna his widow who has since intermarried with Daniel Davis of Darke Co. Ohio and five children as follows: Isaiah P. Brandon of Darke Co. Ohio; Mahala Brandon intermarried with Jacob Snuff, living in Preble Co. Ohio; Robinette Brandon living in Indiana; Mary Brandon who intermarred with Mark Paty of Miami Co. Ohio; and Richard Brandon, aged about 17 years living in Darke Co. Ohio.

That Joseph Brandon, your petitioner, sixth son of Richard Brandon, deceased is now living in Darke Co. Ohio.

That Vincent G. Brandon, seventh son of Richard Brandon, deceased, is now living in Darke Co. Ohio.

That Mary Brandon, daughter of Richard Brandon, deceased, who intermarried with James Hole lives in Darke Co. Ohio.

Your petitioner further represents that all of said children and heirs of Richard Brandn who are named as being deceased, died before said Richard Brandon Senior became deceased and that children and heirs at law of Jonathon Brandon are entitled by descent to an equal one-eighth aprt and children and heirs at law of said Richard Brandon Jr., deceased are entitled by descent to an equal one eighth part and that said children and heirs at law of said Walter Brandon are entitled by decsent to an equal one-eighth part and that said John and David Brandon; Joseph Brandon, petitioner; Vinvent G. Brandon and Mary Hole late Mary Brandon are each entitled to one-eighth part of said undivided premises.

Your petitioner therefore prays that a writ of subpeona may issue against children who may be living of said Richard Brandon, Sr., deceased and against the said cildren and heirs in law.
