Samuel McCluer's Sens [i.e., senior's] Will
In the name God Aman [sic]
I Samuel McClure [sic] of Darke County and State of Ohio being weak in body perfect in mind and memory thank God for his mercy do make this my last will and testament and all other wills and writings are void only this And first I commiy my soul to my God who gave it fully persuaded through the redeemer that my soul will come [to] the mantions [sic - s/b mansions] of bliss. as to my body my desire is that it should be committed to the earth besid[e] my young son William in a decent christianable order Now as to my worldly concerns which it hath pleased God to give me I divide in the following manner First I give and bequeath to my beloved wife [left margin: "v.o."] Rosana [sic] McCluer all my household furniture and family utensils to be for her use and the use of my children now living with me while she my beloved wife lives and [left margin: "v.o."] those my children live singles[?] the household furniture equally to be divided among all my daughters at the death of my beloved wife my large waggon [sic] I allow to be sold and as much of my stock as will pay my debts I also leave and bequeath unto my son John McCluer the quarter section of land I now live on when he comes of age reserving unto my beloved wife Rosanna one third of said quarter and to have the use and benefit of the present improved land while she lives, and as my son Alexander is now of age but yet lives with me I allow him to have the management of the farm while he remains single if that should not be longer than my son John comes of age and to have the benefits and profits arising from said farm after my wife Rosanna and my other children yet living with me receiving a comfortable maintenance I also leave and bequeath to my beloved wife Rosana [sic] while she lives and my two daughters Nancy and Jane while they live single the kitchen end of the house I now live in and the rooms adjoining I also leave and bequeath to my Son Samuel S McCluer the quarter section of land he now lives on I also leave and bequeath to my son Alexander McCluer the quarter section of land I bought from James Alexander I also leave and bequeath to my sons Nathaniel and Alexander my quarter section of land which lies between where my son Nathaniel now lives and the quarter I bought of James Alexander to be equally divided between them upon condition that they give to my daughter Sally one half of the money given for said quarter if she ever stands in need of it each of them to pay an equal proportion I also allow the quarter section of land I bought from John Kerr and also one hunderd acres of my quarter section joining the east side of the quarter I now live in to be sold at the discretion of my executors and the last mentioned quarter to be paid out of the office of the money received for said land I also leave and bequeath to my daughter Elizabeth three hundred dollars to be paid out of the two last described lands when sold I also leave and bequeath to my daughter Nancy three hundred dollars to be paid out of the two last described lands when sold I also leave and bequeath to my daughter Jane three hundred dollars when sold and the balance of the last two described lands to be equally divided among all my children I also allow the blance [sic] of the quarter joining on the east side of the quarter I now live on exclusive of what I have given land to John Miller and the one hundred acres before mentioned to be joined to the quarter to be joined to the quarter [sic - repeated] section I now live on and I also leave and bequeath it to my son John reserving also to my wife Rosanna one third I do constitute and appoint my two sons Nathaniel S McCluer and Samuel McClure my lawful executors In testimony of the foregoing I set my hand and seal this third day of November eighteen hundred and eighteen

Be it remembered that at a Court of Common Pleas holden at Greenville in the county aforesaid on tuesday the first day of December one thousand eight hundred and eighteen Before the Honorable Joseph H Crane Esq President & his associate Judges of our said Court of Common Pleas Came Samuel McCluer Jnr and Nathaniel S McCluer the executors in the within written last will & testament mentioned who exhibit here in Court the within written last will & testament of Samuel McCluer senr now deceased which said last will & tetament being proven by oaths of John Purviance and Nathaniel Wilt two of the subscribing witnesess thereto It is ordered that the same be recorded And thereon the said Samuel McCluer & Nathaniel S McCluer pray administration of the estate of the said Samuel McCluer sen deceased according to the tenor of the said last will and testament and to them it is granted By the Court

To all to whom these presents shall come Greeting
Whereas Samuel McCluer sen late of the County of Darke aforesaid
deceased did by his last Will and testament make ordain constitute and appoint Samuel McCluer Jnr and Nathaniel S McCluer Executors of the same And whereas at a Court of Common Pleas holden at Greenville in the County aforesaid on the first day of December one thousand eight hundred and eighteen Before the Honorable Joseph H Crane President and associate judges of our said court of common Pleas the same last Will & Testament hath been exhibited & duly proven and the Executors therein named therein named [sic - repeated] as aforesaid having signified their Willingness to accept the trust reposed in them by the Testator Therefore be it known that by the said Court of Common Pleas Administration of all and singular the estate of the said Samuel McCluer sen deceased is hereby committed to the said Samuel McCluer Jr & Nathaniel S McCluer Executors as aforesaid to be by them administered according to said and agreeable to the tenor of the said last Will & Testament Provided however that it shall be the duty of the said Executors to have all and singular goods and chattels belonging to the said estate of the said Samuel McCluer sen deceased not otherwise disposed by the said last will and testament Inventoried and appraised by Zadock Smith Jonathan Thomas & Solomon Brodrick freeholders of the county aforesaid and the same Inventory and appraisement together with an accurate statement of the debts due and owing to the said estate to to [sic - repeated] return to the Office of the Clerk of the Court of Common Pleas within three months from the date hereof And furthermore to settle up the said estate so far set forth as the provisions of the said last Will & Testament will admit within twelve months from the date her[e]of And a true and accurate statement thereof to make and return to the court of Common Pleas the law directs[L.S. at left spanning next paragraph]
