[Ullery in 1820, 1830 Greenville census records; married Mary Brown 2-8-1818 - added by transcriber]]In the name of God amen, I David Ulery of the County of Darke and State of Ohio being Sick in body but of sound and disposing mind and memory do make this my last will and testament revoking all others as follows to wit first I give and bequeath unto my beloved wife the use of all my personal property and real property after payment of any debt and funeral expenses during her natural life or widowhood to be used on her own requesting and it is my desire that she may live on the farm I now live on and keep the family together as long as the children are willing to stay with her
Secondly) I give and bequeath unto my son Benjamin one hundred dollars to be paid within one year after the death of my wife
Thirdly) I give and bequeath unto my daughter Polly two hundred dollars to be paid within one year after the death of my wife
Fourthly) I give and bequeath unto my sons George Lenard [sic] Isaac and Martin all the residue of my real and personally [sic] property after payment of my debt and the legaces [sic] herein given to be enjoyed after the death of my wife and to their heirs and assigns forever to be equally divided
Fiftly [sic]) I give and bequeath unto Stephen Ulery a son of my wife by a former mariage [sic] the sum of fifty dollars to be paid within one year after the death of my wife
Sixtly [sic]) In as much as all property I now own was acquired since my marriage with my present wife and believing it to be just that the property this [thus?] acquired go to the children of such marriage therefore I consider that I have given to John Ulery Elizabeth Smith wife of Abraham Smith Bethame [sic] Vannote wife of Joseph Vannote Susan Black wife of Moses Black David Ulery Jacob Ulery Samuel Ulery and Daniel Ulery children by a former wife all that I intend them to receive from my estate weather [sic] real or personal
Seventhly) I appoint my wife Polly and my son Leonard executors of this my last will and testament in testimony whereof I have hereunto Set my hand and Seal this 15th day of February A.D. 1837.

Special Session of the court of common pleas of Dark [sic] County personally came in open court John Beers and Daniel Denise the Subscribing witnesses to a paper purporting to be the last will and testament of David Ulery dec[ease]d who being duly sworn saith that the said the said [sic - repeated] David Ulery sign[ed] the said will and that the[y] signed the same as witness[e]s at his request and that at the time of executing the same was of sound mind and memory at full age and not under any restraint
to their knowledge further saith not
