I Jonathan Smith of the County of Darke and State of Ohio Do make and Publish this my Last Will and Testament in manner and form following that is the to say
First) that my funeral expenses and all my just Debts be fully paid
Second) I give devise and bequeath to my beloved wife Jane Smith all the farm that we now reside on Situate[d] in the County of Darke and State of Ohio Containing about Eighty acres During her natural life and all the Live Stock [&?] horses Cattle Sheep hogs &c [etc.] by me now owned and kept there an[d] all the household furniture we [own] and other items not particularly named or otherwise disposed of in this will During her Natural Life as aforesaid She having first Disposed of a sufficiency there of to pay any just Debts as aforesaid and at the Death of my Said wife all the property hereby devised or bequeathed to her as aforesaid or So much as may then remain unexpended to my three oldest Sons John Smith David Smith and Riley Smith one Dollar Each and to their heirs and [as]signs
Thirdly) I give and Devise to my two oldest Daughters Hanah [sic] Jenkins Rhoda Smith one Dollar each and to their heirs and [as]igns
Fourthly) I Do hereby autherise [sic] my Said wife to Sell and Dispose of Said farm as She shall think best for the suport [sic] of my Seven youngest Children Jonathan M Smith Sally S Smith Sarah An [sic] Smith Ludemia Smith Nancy W Smith and Sarahphena Smith William H H Smith
Fifthly) I do herby give and Devise to my five youngest daughters fifteen Dollars each as the[y] become of age and
Sixthly) I do hereby give and Devise Said farm if not Sold or if Sold the proceeds of Said Sale or so much as that remain unexpended at her Death to my fourth Son Jonathan M Smith and
Seventhly) I give and Devise to youngest Son William H H Smith thirty Dollars at the Death of my Said wife
And Lastly I hereby Constitute and appoint my Said wife Jane Smith to be the executrix for this my last will and testament revoking and annulling all former wills by me made and ratifying and confirming this and no other to be my last will and testament
In testimony whereof I have hereinto Set my hand and Seal this 27th Day May A.D. 1842

Signed Published and Declared by the above Named Jonathan Smith As and for his Last Will And Testament in Presence of us at his Request signed as witnesses To the Same

Joseph TaylorThe State of ohio Dark [sic] County Court of Common Pleas October 7 A. D. 1842 Personally came into open Court Samuel English an [sic] Subscribing witness to the Last Will and testament of Jonathan Smith Late of Said County Deceased the other day ---[?] who being Duly Sworn Depose and Say that he was present at the execution of Said Will that he saw the Testator Sign and heard him acknowledge the Same as his Last will and testament and that at the time of the execution thereof Said Testator was of full age of Sound mind and memory and not under any apparent restraint

ClerkMr. Stephen Long who being duly sworn Saith he is acqua[in]ted with the hand writing of Joseph Ta[y]lor [and] the testator and the Signature of the Said Joseph Taylor and of Jonathan Smith be Said will which Names are genuine and further Saith not
