Darke County } ssBe it remembered that at the July term of the County Court of Common Pleas for said county holden at Greenville in the year of our Lord One thousand Eight hundred twenty nine Before the Honorable George B. Hall [Halt? Holt?] President Judge and James Rush, John Purviance and George Adams Esquire associate Judges of said Court, Came Anna Young, and produced in said court a writing purporting to be the last the last will and testament of Matthew Young late of said County deceased which said note being proven by the depositions of Benjamin Murphy David Fisher and Thomas W. Huffman three of the subscribing witness to said will was ordered by the court to be Recorded. Which said will together with the deposition of the said Benjamin Murphy, David Fisher and Thomas W. Huffman Are as follows to note.

I Mathew Young of Darke County in the State of Ohio being sick and weak in body but sound in mind, considering the certainly of death and the uncertainly of the time thereof and being desirous to settle my worldly affairs, and thenly to be better prepared to leave this world when it shall please God to call me home. I therefore make and publish this my last will and testament in manner and form following That is to say First and Principally I commit my soul into the hands of the Almighty God and my Body to the Earth to be decently buried at the discretion of my Executrix hereinafter named and after my debts and funeral charges are paid I devise and bequeath unto my dear wife Anna Young all the remainder to have and to hold to same till her death and at her death to be equally divided between my children, and lastly I do herby Constitute and appoint my dear wife Anna Young to be sole Executrix of this my last will and testament revoking and annulling all former wills by me heretofore made notifing and confirming this and none other to be my last will and testament
In testimony whereof I Mathew Young have to this my will set my hand and seal this first day of April in the year of our Lord 1829.

Signed sealed and published and declared by Mathew Young the above named testator as and for his last will and testament in the pressence [sic] of us who at his request and in his presence have subscribed our names as witnesses thereto

Court of Common Pleas July term 1829 The last will and testament of Mathew Young dec[ease]d being this 28th day of July 1829 Produced in open Court by Anna Young the Executrix named therein, the same was proven by the oath Benjamin Murphy, David Fisher and Thomas W. Hoffman the subscribing witness to said will who were Sworn and examined in open court and on their oaths depose and say that on or about the 1st day of April 1829 they each saw the name of said Mathew Young and subscribed to the paper now before them by him the said Murphy at the request and by direction of said Young that they each of them signed their own names to said paper as witnesses at the request of said Young and in his pressence [sic] and view that said Young declared the said paper to be his last will and testament of said Young was as they verily believed of sound mind memory and understanding and under no restraints to their knowledge

Attest L R Brownell Deputy ClerkAnd the said Anna Young the widow of Said Mathew Young deceased, and the Executrix in said will named having Signified her willingness to accept of the trust reposed in her by said testator by order of the court gave Bond in the sum of four hundred dollars with James Bryson and Benjamin Murphy her sureties Conditioned according to Law And the said Anna Young was sworn in open court as Executrix of the last will and testament of the said Mathew Young deceased
Therefore Administration of all and Singular the Estate of Mathew Young late of said county dec[ease]d and is this day granted by said court to Anna Young the widow of said Mathew Young dec[ease]d according to the true intent and meaning of said will and agreeably to Law.
The said Anna Young will therefore will [sic] have all and singular goods and chattels of the said Mathew Young dec[ease]d so far as shall come to her knowledge and not otherwise disposed of by said will appraised by Joseph Hu[o?]ffman David Baines and Samuel Pole under oath or affirmation a true and accurate inventory of which signed by appraisers and also a correct Statement of debts due and owing to said estate so far as shall come to her knowledge Signed by herself as Executrix, are to be returned to the clerk of the court within three months from the date hereof And it shall be the further duty of the said Anna Young if any of the goods and chattel belonging to said Estate shall be sold by her to return a true inventory or sale Bill of all goods and chattels so sold and also goods taken by the widow at the appraisment if any to the clerk of the court aforesaid within three months thereafter and within Eighteen months from the date hereof or when thereunto required, it shall be the duty of said Anna Young to have a fair written account Current with paper receipts and vouchers before the court of Common Pleas for the County of Darke aforesaid so that they may inspect and allow and make final settlement thereon
